Terms of Service

Please read these Terms carefully before using ShootSpot (the “Service”), operated by Daniel Pinckard (“we,” “us,” or “our”) at shootspotapp.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use ShootSpot.

1. What ShootSpot Does

ShootSpot is a location management and client-sharing platform for portrait photographers. It allows photographers to build a private library of shoot locations, annotate them with practical details (parking, timing, permits, and personal notes), create curated “session plans,” and share those plans with clients via a tokenized link. Locations may optionally be made public as part of a discovery feature in a future version of the platform.

2. Eligibility

You must be at least 18 years old to use ShootSpot. By creating an account, you confirm that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You will comply with these Terms and all applicable local, national, and international laws.

3. Accounts

3.1 Registration

You may register using your email address and password, or via Google Sign-In. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.

3.2 Accuracy

You agree to provide accurate, complete, and current information when registering and to keep your account details up to date.

3.3 Suspension and Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraud, abuse, or any reason we deem appropriate, with or without notice.

4. Subscriptions and Payments

4.1 Free Tier

ShootSpot offers a free tier with limited features, including a restricted number of private locations and session plans.

4.2 Pro Subscription

A paid Pro subscription is available and unlocks unlimited private locations, unlimited session plans, AI-assisted location enrichment, share link analytics, and custom branding on client-facing share links. Pricing is displayed in the app at the point of purchase.

4.3 Billing

Subscriptions are processed through Stripe, our web payment processor. By subscribing, you authorize recurring charges to your selected payment method at the applicable rate. We do not store your payment card details directly — all payment information is handled securely by Stripe.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date.

4.5 Refunds

We do not issue refunds except where required by applicable law. If you believe you were charged in error, contact us at hello@shootspotapp.com.

4.6 Price Changes

We may update subscription pricing with reasonable advance notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

5. User Content

5.1 Ownership

ShootSpot allows you to upload photos, text, notes, location coordinates, and other content (“User Content”). You retain full ownership of your User Content.

5.2 License to Us — Private and Shared Content

For locations and content you keep Private or Shared, you grant ShootSpot a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service to you and your designated recipients. We do not use private or shared content for advertising or promotional purposes.

5.3 License to Us — Public Content

When you choose to make a location Public, you grant ShootSpot a broader non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and promote that content — including any associated photos, descriptions, and intellectual property — for purposes including but not limited to: making the location discoverable to other users, improving the Service, and marketing or advertising ShootSpot to attract new users through any channels now known or hereafter developed.

We will make every reasonable effort to include attribution to you (by name or username) whenever your public content is featured in a context where attribution is feasible. Attribution is not guaranteed in all contexts, including automated aggregations, platform previews, or third-party promotional placements.

You may change a location from Public to Private at any time. This will remove it from public discovery going forward, but does not retroactively remove content that has already been shared, cached, or distributed in promotional materials.

5.4 Prohibited Content

You agree not to upload, submit, or share content that:

  • Infringes any third-party intellectual property, privacy, or publicity rights.
  • Contains nudity, graphic violence, or sexually explicit material.
  • Includes photos in which a child under the age of 18 is identifiable. Location photos must depict scenery, landscapes, or environments only — not people.
  • Is defamatory, harassing, threatening, or abusive toward any person.
  • Violates any applicable law or regulation.
  • Contains malware, viruses, or other harmful code.
  • Misrepresents your identity or affiliation with any person or organization.

5.5 AI Processing of Your Content

By using ShootSpot, you agree that we may use automated systems and artificial intelligence to organize, analyze, tag, enrich, and review your submissions — including location names, descriptions, photos, and notes — for the purpose of improving search functionality, generating location recommendations, moderating content, and enhancing the overall user experience.

AI processing may be performed by ShootSpot directly or through trusted third-party AI service providers. Such providers are contractually prohibited from using your content to train their own models or for any purpose beyond the specific services they provide to us.

5.6 Location Data Responsibility

You are responsible for ensuring you have the legal right to photograph, access, and share information about any location you add to ShootSpot. We do not verify the accuracy of location information or confirm that any location is legally accessible.

6. Privacy States and Sharing

Each location you add can be assigned one of three privacy states:

  • Private — visible only to you.
  • Shared — accessible via a unique tokenized link that you control and distribute.
  • Public — visible to all ShootSpot users (optional feature, available in a future release).

You are solely responsible for managing the privacy settings of your locations and session plans. ShootSpot is not responsible for unintended disclosure resulting from links you choose to share.

7. Client-Facing Share Links

Session plan share links allow recipients to view a curated selection of your locations without creating a ShootSpot account. By generating and sharing a link, you acknowledge that:

  • Any person with the link can access the shared content.
  • You should not include sensitive private notes in content intended for client views.
  • ShootSpot is not responsible for how link recipients use or further distribute your shared content.

8. Intellectual Property

The ShootSpot name, logo, interface design, and all underlying software are the intellectual property of Daniel Pinckard. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our express written permission.

9. Third-Party Services

ShootSpot integrates with third-party services including Google (authentication and maps), Supabase (data storage), Stripe (payment processing), Resend (transactional email), and third-party artificial intelligence providers used for content enrichment, search improvement, and moderation. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DANIEL PINCKARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Daniel Pinckard, and any officers, agents, or affiliates, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which you reside, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document and notify you via email or an in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

15. Evolving Service

ShootSpot is an actively developed product. Features, workflows, pricing, and platform integrations are subject to change — sometimes rapidly. We will make reasonable efforts to communicate significant changes, but you acknowledge that:

  • New features may be introduced, and existing features may be modified or removed, at any time.
  • The Service is provided in its current state and may not yet include all features described in marketing materials.
  • Planned features described as “coming soon” or “future release” are not guaranteed to ship on any particular timeline or at all.

We appreciate your patience and support as we build ShootSpot. Your feedback helps shape the direction of the product.
